There is currently forage planted on the arable acres on the SE quarter under a 10-year agreement with DUC. It expires in 2026.
- If you are talking to grain farmers individually, you could let them know we could discuss this forage agreement and they could potentially buy out the remaining years. That’s not an option with the perpetual CE however
There is a DUC perpetual conservation agreement registered on title that protects approx. 153acres of wetland and grassland/scrubland on the half section.
The table on each quarter section sketch outlines the number of acres and the sketch shows wetlands in blue and grass/scrubland in brown; both outlined in yellow.
Here are the details in layman’s terms.
- The agreement with DUC is in perpetuity (runs with land forever)
- The agreement protects habitats from breaking and draining but haying and grazing are not restricted.
- The only exception to this is the wetland on NE3 that is labeled as #5. This is what we consider an Occasionally Cultivated Wetland (OCW) and this ONE may be cultivated through when dry.
- There are no restrictions by DUC on the areas not indicated by cross hatching. That is they can cultivate the typically cultivated acres not under agreement.
- Landowner pays the taxes
- Landowner governs right of access / hunting etc.
- Basically, they farm but go around the existing habitat that is there and there is not a lot of opportunity for additional acres on this one given most all habitat is under agreement
If there are folks interested from the livestock industry, DU does have a forage program that would help them recoup seed costs if they were interested to sow arable acres to hay or pasture, as well as other incentives that may assist with fencing or offsite watering.
